THE LEGISLATURE: A MECHANISM FOR SOCIAL JUSTICE AND GOOD GOVERNANCE-OZIOMACHI

Before the conceptualisation of modern legislation, the Igbo pre-colonial administration exhibited legislative resemblances in its operations. For instance, the council of elders and village assembly, which made laws for proper administration, embodied all the functions outlined within the legislative pattern. Comprised of representatives from all clans and village heads, this body deliberated, legislated on matters of importance, authorized expenditure, and exercised periodic oversight through the age-grade system, which held statutory oversight functions. This demonstrates that the historical origin of legislation can not be solely traced through Western examples like the Athenian Ecclesia, the Roman Senatus, and the English Parliament without acknowledging the Igbo example.

The institutionalization of a modern and separate legislative arm, distinct from the executive and judiciary, is a hallmark of modern democracy. This concept is rooted in the principle of separation of powers, championed by thinkers like John Locke, Charles-Louis de Secondat (Baron de Montesquieu), and James Madison. Montesquieu's advocacy for a system of checks and balances has been particularly influential in shaping modern democratic governance

In society, social segregation and class distinctions can lead to prejudices that exclude certain groups. However, the legislature plays a crucial role in promoting social justice through equitable distribution and redistribution of resources. As representatives of the people, legislators ensure that their constituencies are covered and represented during key legislative moments, such as budget passage. A notable example is the ongoing smart schools and hospital projects in Abia State, which cover all 17 local government areas, promoting inclusive development and access to quality education and healthcare.

The foregoing does not only demonstrate separation of powers, but equally a harmonious cooperation between the executive and the legislative arms of government in promoting social justice and good governance

The legislature plays a pivotal role in promoting social justice through its budgetary functions, ensuring equitable revenue allocation and infrastructural distribution. Additionally, it fosters good governance by exercising oversight and maintaining checks and balances, thereby holiding the executive branch accountable.
